1980年8月26日，第五届全国人民代表大会常务委员会第十五次会议通过了《中华人民共和国律师暂行条例》。这是中华人民共和国关于律师制度的第一部法律，也标志着中国律师制度的恢复和重建。
所谓律师咨询，是指律师为当事人解决现实生活中遇到的法律问题。随着公众法律意识的提高，许多当事人通常主动通过互联网或电话咨询了解诉讼风险或其他解决问题的方式。
当一些人遇到法律纠纷时，虽然他们会咨询律师，但由于他们没有与律师签订委托代理合同，他们签订委托代理合同。这种做法是不可取的。如果当事人所表达的真相是错误的，律师的建议可能是不准确的。因此，当事人在咨询律师时，应当如实提供真相，故意隐瞒事实，最终可能损害其合法权益。

当你委托律师帮助处理法律事务时，切记，要密切配合你的律师开展工作！
很多委托人经常挂在嘴边的一句口头禅就是：“律师，我已经全权委托你了，这些工作应该由你去做呀？”但是，真应该这样吗？
根据《中华人民共和国律师法》第二十八条的规定，律师代理你开展工作时，你和律师的关系属于委托代理关系，而并非承揽关系（俗称承包关系）。根据《中华人民共和国民法典》第一百六十二条的规定，律师在代理权限内，以你的名义实施的民事法律行为，对你发生效力。根据上述法律关系可见，律师代理你正常开展工作，显然无论结果的好与坏，均是由你本人承担的。这些结果并非像加工、修理、制作实物那样以物质形态呈现，因此这也是法律规定为委托代理关系而非承揽关系的原因之一。
律师代理你处理法律事务时，无疑需要你的密切配合，因为你是当事人，掌握的信息比较充分，且有些事情现实中只有你才能办到，比如提取保存在你或你亲朋戚友手中的证据，请求你居住地社区出具证明，请求你的证人出庭作证等等。
密切配合你的律师工作，正如同你本人努力工作，方向对了，越努力成功越大。反之，做甩手掌柜，结果是很难达到预期的。

When you entrust a lawyer to help handle legal affairs, remember to work closely with your lawyer!
A proverb often used by many clients is: "Lawyer, I have entrusted you with full power, and you should do the work?" But should this be true?
According to the provisions of Article 28 of the Lawyers Law of the People's Republic of China, when a lawyer acts for you, the relationship between you and the lawyer belongs to the principal-agent relationship, not the project contract relationship. According to the provisions of Article 162 of the Civil Code of the People's Republic of China, a civil legal act performed by a lawyer in your name within the scope of authority shall be effective for you. According to the above legal relationship, it can be seen that the lawyer's normal work on your behalf is obviously borne by you, no matter the result is good or bad. These results are not presented in material form like processing, repairing and physical objects, so this is one of the reasons why the law stipulates that the relationship is principal-agent relationship rather than project contract relationship.
When the lawyer handles legal affairs on your behalf, you undoubtedly need your close cooperation, because you are the client and have sufficient information, and some things can only be done by you in reality, such as extracting the evidence stored in you or your relatives or friends, requesting the residents committee of your residence to issue a certificate, requesting your witnesses to testify in court, and so on.
Work closely with your lawyer, just as you work hard. If the direction is right.,the harder you work, the greater your success. On the contrary, if you don't cooperate with anything, it will be difficult to achieve the expected results.
